Settlement Amount in Mutual Divorce in India: How It Is Decided - AM Legal, Delhi

Quick answer: There is no fixed formula for settlement amount in mutual divorce in India. Spouses agree on a figure, and courts check that it is voluntary. The factors usually considered are those in Rajnesh v. Neha (2020): income and assets, needs of the wife and children, standard of living, duration of marriage, employment and sacrifice, and liabilities.

No fixed amount

Indian law does not say that a spouse must pay a fixed percentage of income or assets. In a mutual consent divorce, the amount is negotiated, and the court mainly checks that consent is free. But the same factors that courts use in contested cases influence what is reasonable.

Factors courts consider

The Supreme Court in Rajnesh v. Neha (2020) and later cases highlighted factors such as:

  • status and income of both spouses;
  • reasonable needs of the wife and dependent children;
  • educational qualifications and employability;
  • independent income and assets of each spouse;
  • standard of living during marriage;
  • duration of the marriage;
  • sacrifices such as career breaks for family;
  • liabilities and obligations of the payer;
  • litigation costs.

The Court also requires disclosure of income and assets by affidavit. Recent decisions stress that permanent alimony should be fair and not punitive. See calculating alimony in Delhi and alimony and maintenance laws.

What a settlement usually covers

HeadExamples
One-time alimonyLump sum in full and final settlement
Monthly maintenanceFor spouse until remarriage or for a fixed time
Child maintenanceSchool fees, medical costs, monthly support
Stridhan and dowryReturn of jewellery and gifts
PropertyTransfer of flat, car, share in jointly owned property
Pending casesWithdrawal or quashing of DV, 498A, maintenance cases

Payment structure

Safer settlements split the payment: for example a part at the first motion, a part when related cases are quashed or withdrawn, and the balance at the second motion or decree. Pay by bank transfer and record every payment. Never agree to cash.

Mistakes to avoid

  • Agreeing without disclosing all assets and income.
  • Trading child custody for money.
  • Leaving pending cases out of the deed.
  • Not considering income tax and property transfer formalities. Consult a chartered accountant.

Frequently asked questions

How much alimony is given in mutual divorce in India?

It depends on income, assets, marriage length, children and needs. There is no fixed formula.

Is a lump sum better than monthly maintenance?

A lump sum gives finality, monthly payments give ongoing support. Choose based on needs and risk of default.

Can the wife claim a share of the husband's property?

She has no automatic share in his self-acquired property, but settlements often include property transfers and the court considers contribution and rights in joint assets.

Is child maintenance part of the settlement?

Yes. A child's right to maintenance cannot be bargained away by the parents.

Can I change the settlement later?

Generally not, unless the decree allows it or there is fraud. Take advice before signing.
