Property Disputes in Gurugram: What to Know Before You Act
Gurugram has one of the most active real estate markets in India, and with it comes a steady flow of disputes between buyers and builders, co-owners, landlords and tenants, and families dividing inherited land. Acting early and in the right forum usually saves both money and time. This section explains the most common property problems in Gurugram and the legal routes available.
Buyer and builder disputes under RERA
Home buyers who face delayed possession, deviation from the sanctioned plan or refusal to refund can file a complaint with the Haryana Real Estate Regulatory Authority (HRERA), Gurugram. The Real Estate (Regulation and Development) Act, 2016 allows buyers to claim interest for delay or a refund with interest, and requires promoters to register projects. Complaints before the Authority are generally faster than a civil suit, and appeals lie to the Real Estate Appellate Tribunal in Haryana. Consumer commissions are another option in some cases.
Title, mutation and revenue records
Before buying land or a flat, the title should be checked through the sale deed chain, the jamabandi (record of rights), the latest mutation entry, encumbrance details and approvals. Errors in revenue records can be corrected through the revenue officers, and a civil court can decide questions of title and possession. Where the seller has not performed the agreement to sell, a suit for specific performance must ordinarily be filed within three years of the date fixed for performance, so delay can cost you the remedy.
Partition and inheritance
Disputes over ancestral or inherited property are decided according to the personal law of the family, such as the Hindu Succession Act, 1956 for Hindus. A partition suit can be filed in the civil court, and settlement through mediation is often possible. A suit for possession based on title can generally be filed within twelve years from when the possession of the other party became adverse. Getting a registered family settlement or a partition deed can prevent litigation later.
Tenancy, eviction and rent recovery
Eviction and recovery of rent are governed by the lease terms and the Haryana rent law. A written and registered rent agreement, a proper legal notice and a record of payments make the case much stronger. We advise both landlords and tenants on notices, eviction petitions and settlements.
Frequently asked questions
Can I file in both HRERA and a civil court? The Authority and civil courts have different powers, and the right choice depends on your facts. We will advise you on the best forum after reviewing your documents.
What documents should I carry? Bring the builder-buyer agreement, payment receipts, allotment letter, sale deed, mutation or jamabandi extracts and all correspondence with the other side.
Do you appear in Gurugram courts? Yes. AM Legal handles Gurugram property matters alongside its Delhi practice; call us to confirm the right forum for your case.
