Mutual Divorce and Child Custody in India: Joint Custody, Visitation and Maintenance

Quick answer: In a mutual consent divorce the parents can agree on custody, visitation and child maintenance, but the court still checks that the arrangement is in the child's best interests (Section 26 HMA). Options include sole custody with visitation, or joint or shared custody. A child's right to maintenance cannot be waived by the parents.
Custody is agreed, but the court reviews it
In mutual divorce, you and your spouse decide who will look after the child, how the other parent will spend time with the child, and who will pay expenses. The judge does not simply rubber-stamp it. Section 26 of the Hindu Marriage Act lets the court pass orders on custody, maintenance and education of minor children, and the guiding principle is the welfare of the child, a standard repeated in many cases such as Nil Ratan Kundu v. Abhijit Kundu (2008). See also child custody battles and the best interests standard.
Types of arrangements
| Arrangement | How it works |
|---|---|
| Sole custody with visitation | One parent has day-to-day care; the other has fixed visits and calls |
| Joint legal custody | Both share major decisions on education, health and religion |
| Shared physical custody | Child spends substantial time with each parent |
| Split arrangements | Used rarely, usually with siblings kept together |
Indian courts increasingly recognise shared parenting where both parents are fit and live close by. In Yashita Sahu v. State of Rajasthan (2020) the Supreme Court emphasised that a child benefits from access to both parents unless there is a reason to limit it.
What to put in the settlement
- Where the child will live and go to school.
- Weekly, holiday and festival schedules for the other parent.
- Video calls and phone contact.
- Who pays school fees, tuition, medical costs and insurance.
- Travel and passport rules, including consent for travel abroad.
- Dispute resolution, such as mediation before litigation.
Do not trade custody for money. A court will look unfavourably at an agreement that appears to do so.
Child maintenance
Both parents are responsible for supporting the child, and the right to child maintenance belongs to the child. Even if parents agree otherwise, a court can revisit it if the child's needs are not met. See settlement amount in mutual divorce and alimony and maintenance laws.
If you cannot agree
If you cannot agree on custody, the mutual petition will not be accepted until you do. Options include mediation, or a separate custody petition under the Guardians and Wards Act. See child custody after divorce in Delhi and our child custody lawyers in Delhi.
