Divorce on Grounds of Cruelty and Desertion by Wife: Husband's Legal Guide - AM Legal, Delhi

Quick answer: A husband can file for divorce under Section 13(1)(ia) HMA for cruelty and Section 13(1)(ib) for desertion if his wife has left without reasonable cause for a continuous period of at least two years immediately before the petition. He must prove the separation, her intention to end cohabitation, no consent from him, and no reasonable cause for leaving.

Two separate grounds

GroundSectionRequirement
Cruelty13(1)(ia)Treatment causing mental or physical harm so that living together is unreasonable
Desertion13(1)(ib)Abandonment without reasonable cause for a continuous period of at least two years before the petition

They can be combined in one petition. See also cross-allegations of cruelty, desertion and adultery.

Elements of desertion

The Supreme Court in Bipin Chander v. Prabhawati (1957) explained that desertion needs:

  1. Factum of separation: the wife has actually left.
  2. Animus deserendi: intention to end cohabitation permanently.
  3. No consent: the husband did not agree or drive her away.
  4. No reasonable cause: she had no justification, for example abuse by the husband.
  5. Two years: continuous period before filing.

If the wife left because of cruelty or violence, the husband's petition may fail and she may have strong counterclaims.

Evidence the husband should collect

  • Dates and circumstances of the wife's departure.
  • Messages and emails inviting her to return and her replies.
  • Legal notice calling upon her to resume cohabitation and proof of service.
  • Witnesses to the separation.
  • Records of payment of maintenance, to show you did not abandon her.
  • Evidence of cruelty: abusive messages, false complaints, public humiliation.

A petition for restitution of conjugal rights can also be used. See restitution of conjugal rights.

Frequently asked questions

How long must the wife be away to claim desertion?

Two years continuously, immediately before the petition.

What if she left because of my family?

If she had reasonable cause, it is not desertion. Evidence of her reasons matters.

Can I file for both cruelty and desertion?

Yes, in the same petition.

Does sending a notice help?

Yes. A notice inviting her to return, and her response, helps show her intention.

Will I have to pay maintenance?

The court may order interim maintenance for a wife and children if she cannot support herself.
