Cruelty Includes Mental Harassment and Long Continuous Separation: Indian Divorce Law

Quick answer: Under Section 13(1)(ia) HMA, cruelty includes mental harassment, and the Supreme Court in Samar Ghosh v. Jaya Ghosh (2007) said that a long, continuous separation with no chance of reunion can itself indicate that the marriage is dead and can amount to mental cruelty. Separation alone is not an automatic ground; it works with other facts.
Cruelty under the HMA
The Hindu Marriage Act lists cruelty as a ground for divorce but does not define it. Courts decide case by case, whether the conduct is of such a kind that the petitioner cannot reasonably be expected to live with the respondent. The test is practical and depends on the parties' background, education and circumstances.
Samar Ghosh v. Jaya Ghosh (2007)
The Supreme Court gave illustrative situations of mental cruelty, including:
- sustained abusive, humiliating or insulting treatment;
- persistent acts that cause constant mental agony;
- unjustified neglect and indifference;
- unfounded accusations of infidelity or character;
- false complaints and repeated litigation;
- long continuous separation where the marriage is dead and has no chance of revival;
- persistent refusal to have marital intimacy without reason.
The Court cautioned that normal wear and tear of married life, mere quarrels and trivial irritations do not amount to cruelty.
Long separation as cruelty
Where spouses have lived apart for many years, and attempts at reconciliation have failed, the Court has said that it is cruelty to force a dead marriage to continue. This idea led to calls for "irretrievable breakdown" as a ground; see irretrievable breakdown. But courts want to see the full picture: who caused the separation, whether the petitioner made an effort, and how long it lasted.
What to prove in your petition
- Duration and reason for separation. Dates, where each of you lives, who left and why.
- Efforts at reconciliation. Meetings, mediation, notices, family attempts.
- Specific acts of harassment. Dates, messages, witnesses.
- Impact. Medical or counselling records.
- Current position. Whether there is any chance of living together.
