Role of Lawyers in Reporting and Handling Domestic Violence in India

Quick answer: A lawyer helps a woman facing domestic violence by explaining her legal options, collecting and organising evidence, drafting the Section 12 application, seeking urgent interim protection, coordinating with the police and Protection Officer, and representing her until the case ends. Free legal aid is available to women through the Delhi State Legal Services Authority.
Why legal help matters early
Women often delay seeking help because of fear, family pressure or lack of information. A lawyer can explain, in one meeting, what remedies exist, which are safe and which are risky, and how each will affect children, housing and money. Early advice also prevents mistakes such as leaving the home without taking documents, or signing papers under pressure.
What a lawyer does, step by step
- Listens and assesses risk. Safety comes first. The lawyer asks about immediate danger, shelter needs and children.
- Organises evidence. Medical reports, messages, call logs, photographs, financial records and witness names.
- Chooses the right forum and relief. DV Act application, police complaint, maintenance, divorce, custody, or a combination. See the case procedure.
- Drafts the application and affidavit. Clear facts, specific reliefs, correct respondents.
- Seeks urgent orders. Section 23 interim and ex parte relief.
- Coordinates support. Protection Officer, police, shelter homes, counsellors, medical care.
- Represents her through trial, appeal and enforcement.
Reporting and confidentiality
Lawyer-client communication is confidential. The lawyer cannot disclose what you say without your consent, except in narrow situations the law allows. The DV Act also lets proceedings be held in camera under Section 16, so the hearing is not public.
A lawyer will not file a police complaint or application without your instructions, and will explain the consequences first, since a criminal complaint cannot be casually withdrawn.
Free legal aid
Under the Legal Services Authorities Act, 1987, women and children are entitled to free legal services regardless of income. In Delhi you can approach the District Legal Services Authority at the court complex, or the Delhi State Legal Services Authority. The Protection Officer is also required to help you get legal aid under the DV Act.
When to call a lawyer
- immediately after a serious incident or threat;
- before you leave the shared household;
- when you receive a legal notice or summons;
- when the other side proposes a settlement;
- before you sign any consent terms, divorce papers or affidavits.
