Criminal Matters Before the Supreme Court of India: How the Process Works
A criminal case reaches the Supreme Court of India in a few well-defined ways. Understanding them early helps you choose the right remedy and avoid missing a deadline. This section gives an overview of the most common routes; the right choice always depends on the facts and the orders already passed by the lower courts.
Special Leave Petition against a High Court order
Under Article 136 of the Constitution, the Supreme Court can grant special leave to appeal against almost any judgment or order of a court or tribunal in India. In criminal matters this is how most convictions, acquittals, bail orders and quashing orders of the High Courts are challenged. A petition is generally filed within 90 days of the High Court judgment, and delay must be explained in an application for condonation. The Court first decides whether to grant leave and, if it does, hears the appeal on merits.
Bail and anticipatory bail
When a High Court has refused bail or anticipatory bail, an accused can approach the Supreme Court. The Court considers the nature and gravity of the offence, the role attributed to the accused, the stage of investigation or trial, the risk of tampering with evidence or absconding, and the period already spent in custody. Interim protection or release on conditions can be sought where the situation is urgent.
Quashing of FIRs and proceedings
Where an FIR or a criminal complaint is an abuse of process, the High Court can quash it under Section 482 of the Code of Criminal Procedure, now Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. If the High Court declines, the Supreme Court can be approached by special leave. A writ petition under Article 32 is available where fundamental rights such as personal liberty are directly affected.
Appeals, review and curative petitions
Convicted persons may appeal where the law gives that right, and the State can challenge acquittals. After a judgment, a review petition may be filed within thirty days on limited grounds such as an error apparent on the record. As a last remedy, the Court has recognised the curative petition for cases where there is a gross miscarriage of justice.
Who can file in the Supreme Court
Under the Supreme Court Rules, matters are ordinarily filed through an Advocate-on-Record, who is responsible for the correctness of the filing. At AM Legal we coordinate the entire chain, from the trial court record and High Court order to the paper book, so that your petition is complete and filed on time.
Frequently asked questions
How long does a Supreme Court criminal case take? Timelines vary widely. Urgent bail matters can be listed within days, whereas regular appeals may take much longer. We will give you a realistic view after reading your file.
Can I file directly without going to the High Court? In most cases the High Court must be approached first. Article 32 is the exception for direct infringement of fundamental rights.
What documents do I need? The FIR, charge sheet, trial and High Court orders, bail applications and any certified copies already obtained.
